Godwin Emefiele Challenges Court Decision Over Alleged $4.5 Billion, N2.8 billion Fraud

Godwin Emefiele, the former Governor of the Central Bank of Nigeria (CBN), challenged the Lagos State Special Offences Court’s jurisdiction to consider the $4.5 billion and N2.8 billion fraud charges the Economic and Financial Crimes Commission (EFCC) had brought against him.

The court denied his application on Wednesday. In his decision, Justice Rahman Oshodi stated that the court was able to try Emefiele and Henry Omoile, his co-defendant. However, the judge ruled that the EFCC lacked jurisdiction and dismissed four of the 26 accusations against the defendants.

According to the Court: “The objection challenging the court’s territorial jurisdiction over counts eight to 26 fails and is hereby dismissed. The prosecution has established sufficient territorial nexus in this case.”

To accomplish this, on February 24, 2025, the judge postponed the case for trial continuation. Emefiele was charged by the EFCC with 26 offences, including official misconduct and unlawful distribution of N2.8 billion and $4.5 billion.

Mr Olalekan Ojo (SAN), Emefiele’s attorney, contended that the court lacked jurisdiction to hear the matter in Lagos at the final adjourned date on December 12, 2024.

However, on June 14, 2023, the government of President Bola Ahmed Tinubu suspended the troubled Emefiele as governor of CBN.
