ADVAN Clarifies Position On Pending Lawsuit Against ARCON Amidst Recent Court Ruling Involving Digi Bay Limited

The Advertisers Association of Nigeria (ADVAN) wishes to address recent media reports and growing public interest following a ruling delivered by the Federal High Court, Lagos Judicial Division, in Suit No: FHC/L/CS/1262/2024 – Digi Bay Limited (trading as Betway Nigeria), Super Group Limited, and Otunba Kunle Olamuyiwa v. Attorney General of the Federation and the Advertising Regulatory Council of Nigeria (ARCON).

ADVAN categorically states that the ruling in the Digi Bay case has no bearing, influence, or legal consequence on our ongoing suit. ADVAN is not a party to the Digi Bay proceedings and is therefore not privy to the ruling. Importantly, the Digi Bay matter differs significantly from ADVAN’s case — both in factual context and the legal reliefs being sought.

To avoid any confusion, we reiterate that the subject matter and legal issues addressed in the Digi Bay case are distinct from those in ADVAN’s pending suit (Suit No: FHC/L/CS/2089/2023 – Registered Trustees of Advertisers Association of Nigeria v. ARCON & 6 Ors), which remains active before the Honourable Justice Allagoa of the Federal High Court, Lagos.
