Oga Sabinus Sues Peak Milk, UAC Foods For Using Trademark ‘Something Hooge’

Popular comedian and skit maker, Chukwuemeka Ejekwu also known as Oga Sabinus threatened to sue Peak Milk and UAC Foods, the makers of the sausage roll Gala.

Brand Spur Nigeria learnt that Oga Sabinus will be suing the aforementioned brands over the unauthorised usage of his trademark.

Oga Sabinu is demanding a respective N1 billion and N100 million from Peak Milk and Gala in compensation and damages for the consequent use of the catchphrase ‘something hooge’ in an advert on its social media handle and the use of his picture in an ad campaign.

Sabinus’ lawyer  claimed that the phrase ‘something hooge’ was trademarked and legally reserved as his intellectual property by the Federal Ministry of Trade and Investment.

“Our client briefed us and we believe the same to be true that your Company, Friesland Foods Wamco Nigeria Plc, used a trademarked slogan ‘Something Hooge’ for the promotion of your Peak Milk product,”

“The advert which was made on the Peak Milk Nigeria verified Instagram page (peak_milk) was posted on the 24th day of May 2022 which was used to promote the Peak National Breakfast Week.

“It will interest you to know that the phrase ‘something hooge’, which was popularized by our client, has been trademarked and legally reserved as his intellectual property by the Federal Ministry of Trade and Investment.

“The said slogan was trademarked on the 26th of November 2021 with the file number: NG/TM/O/2021/48316. 10. On this note, we make the demand for the payment of the sum of Five Hundred Million Naira (N500m) as compensation for the unauthorized use of the intellectual property belonging to our client.

“And another five hundred million Naira for damages for the trauma; emotional, physical, psychological, and mental trauma our client has suffered for the Trademark theft and infringement of his intellectual property rights.

“We also pass a stern warning for your company to cease and desist forthwith the use of slogans, expressions, images, or any other intellectual properties belonging to our client without his express consent and authorization.”

In another notice, Sabinus also accused UAC Foods Ltd of using the brand picture and other intellectual properties of Sabinus to make adverts without his consent. The statement read, “Your company UAC Food Ltd. has been using the brand picture and other intellectual properties of Sabinus to make adverts for your Gala sausage roll without the consent or authorization of our clients,” another notice read.

“You made a post on your verified Instagram handle (gala sausage roll), on the 23rd of May, 2022 with the picture of our client. The post which was a cartoon of our client was captioned ‘the way I calculate everything in my life’.

“We demand that you pay our client the sum of one hundred million Naira (N100m) for the use of the picture which is the average fee our client charges for his picture to be used for adverts and promotions.

“It will be in your best interest to heed our warning and meet our demands and if at the end of 14 working days.”

As of press time, both companies are yet to respond to the claims by Oga Sabinus’ through his lawyers.

Customer Cries Out For Help As FCMB And Konga Nigeria Withhold His Money

Ola Moses, a Lagos-based music promoter, has accused First City Monument Bank (FCMB) and Konga Nigeria of withholding his N67,000 for over two months.

Brand Spur Nigeria reports that Moses told FIJ that he placed an order for a pair of clothing needed for a music video on March 3 but it failed.

“While placing the order on Konga, I used my FCMB master debit card for payment. I received a notification for a failed transaction,” he said.

“I did not receive an SMS debit alert, but while going through my email, I saw a notification. I waited, hoping it was a network error, but for over two weeks, the money was not reversed.”

Moses told FIJ that he contacted FCMB regarding the failed transaction and they sent him proof that the money was with Konga Nigeria.

“After receiving the proof from FCMB, I contacted Konga and they asked for my order number, which I sent it to them. Every information they requested, I made sure that I presented to them, yet my money was not reversed.”

Moses told FIJ that after several days without a feedback, he reached out to them via a call and was assured that the complaint would be looked into and the debit reversed.

“The lady from Konga told me she would escalate this complaint to the account department for necessary steps. She assured me that my money would be sent to me soon,” he said.

Moses told FIJ he had not received any reversal yet.

As of press time, neither FCMB or Konga have responded to the allegations.

Nigeria’s Foreign Reserve Drops As CBN Provides Explanation

Nigeria’s external reserve has dropped to a seven-month low as exporters, politicians and others tightened their grip on dollars.

According to data obtained from the CBN website, Naira fell to $38.57 billion as of May 25, 2022. The last time it was at this level was in late October 2020.

The drop in Nigeria’s reserves will make defending the Naira from further devaluation more difficult.

Already, many banks are extending the waiting period to access forex for foreign trips, thereby denying travellers with urgent trips access to apply for Personal Travel Allowance or the Business Travel Allowance requests and this is fueling demand at the black market.

Brand Spur Nigeria recalls that Ripples Nigeria reported that one of the banks in a note to its customers said, “All requests are reviewed to ensure that they meet regulatory requirements.

“In addition, due to limited forex availability provided by the Central Bank of Nigeria, we require a 30-day period to fulfil requests for school fees, upkeep and rent payment.”

In his explanation on Nigeria’s dwindling reserves despite international oil prices trading above N100 per barrel Godwin Emefiele, the CBN Governor blamed the high cost of importation.

Emefiele noted this at the last Monetary Policy Committee meeting held last week.

His words, “Nigeria’s dwindling foreign reserves can be attributed to the weak accretion to the reserves from exports and the high cost of importation of refined petroleum products.”

Top Globacom Staff Commits Suicide In Lagos

An accountant with telecom company, Globacom, Folake Abiola, has been reported dead having reportedly committed suicide at her residence at Osapa London, in the Lekki area of Lagos State.

Brand Spur Nigeria gathered that the 45-year-old Globacom staff reportedly drank a dangerous substance suspected to be insecticide on Friday.

The state Police Public Relations Officer, Benjamin Hundeyin, said the police visited Abiola’s house and met her dead.

Hundeyin said, “The moment the police in that area were alerted, they arrived at the scene and met the woman lifeless on the floor. A bottle of insecticide was also found by her, apparently, she had ingested that insecticide.

“The family members that were there officially wrote to the divisional police officer requesting for the release of the corpse to enable them to bury her in accordance with Islamic rites and the corpse was released to the family on compassionate grounds”, he added.

The reason for her action is still unknown, though many have opined that she may have been driven to the act by depression.

Dollar To Naira Exchange Rate: Naira Drops Across Forex Markets

Naira has continued its depreciation across all forex markets due to low dollar supply at the official market.

According to data obtained from FMDQ Securities Exchange Naira’s value against the US dollar dropped on Friday by 0.15 per cent or 62 kobo to close at N419.50/$1 compared with the N418.88/$1 it was transacted the previous day.

During trading on Friday forex supply to the official market declined by $49.62 million or 31.5 per cent to $107.84 million compared with the $157.46 million executed a day earlier.

Dollar To Naira Exchange Rate: Naira Drops Across Forex Markets

Naira also depreciated in the Peer-to-Peer (P2P) segment of the foreign exchange market against the Dollar by 0.16 per cent or N1 to N617/$1 in contrast to the previous day’s N616/$1.

It was also a similar story against the Pound Sterling as it dropped by N1.01 to trade at N524.57/£1 compared to the previously traded rate of N523.56/£1.

Also against the Euro, the domestic currency fell by 19 kobo to close at 445.26/€1 in contrast to N445.07/€1.
